1. Acceptance of Terms

By downloading, installing, or using the Maxximo iOS application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms please do not use the App. These Terms apply to all users of the App.

2. Description of Service

Maxximo is a self improvement iOS application that uses artificial intelligence to analyze facial features and provide personalized improvement recommendations. The App provides:

• AI-powered facial feature analysis
• Personal improvement scores
• Personalized 30-day improvement roadmaps
• Progress tracking over time
• Grooming, fitness and style recommendations

Maxximo is intended for personal self improvement purposes only. Results are generated by artificial intelligence and should not be considered professional medical, dermatological or psychological advice.

3. AI Analysis & Face Data

By using the scan feature in Maxximo you acknowledge and agree to the following:

• When you initiate a scan your photo is captured and sent securely to OpenAI's GPT-4o API for facial feature analysis
• OpenAI processes your image to generate improvement scores and recommendations and does not retain your image after processing
• You explicitly consent to your face photo being sent to OpenAI for this purpose before your first scan
• Analysis results are stored locally on your device only and are not transmitted to Maxximo's servers
• You must be at least 13 years of age to use the scan feature
• You must only submit photos of yourself — submitting photos of other people without their consent is strictly prohibited
• AI generated scores and recommendations are for self improvement guidance only and do not constitute any form of medical or professional advice
• Results may vary and Maxximo does not guarantee any specific improvement outcomes

4. Subscriptions & Payments

Maxximo offers auto-renewable subscriptions for access to premium features:

• Monthly Plan: $6.99 USD per month
• Annual Plan: $29.99 USD per year

All subscriptions include a 7-day free trial for new subscribers. The following terms apply to all subscriptions:

• Payment is charged to your Apple ID account upon confirmation of purchase or at the end of the free trial period
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscription at any time in your iPhone Settings under your Apple ID
• No refunds are provided for partial subscription periods
• Free trial periods cannot be used more than once per Apple ID
• Prices are in USD and may vary by country based on local App Store pricing

5. Free Tier Limitations

Free users of Maxximo are limited to one scan per day. Additional scans and premium features including full AI breakdown, personalized roadmap, progress history and before and after comparison require an active Maxximo Pro subscription.

6. Acceptable Use

You agree to use Maxximo only for lawful personal self improvement purposes. You must not:

• Submit photos of other people without their explicit consent
• Use the App to harass, bully or demean yourself or others
• Attempt to reverse engineer or exploit the App or its AI systems
• Use the App for any commercial purpose without written permission
• Share AI generated results in a way that demeans or objectifies other people
• Use the App if you are under 13 years of age

7. Disclaimer of Medical Advice

Maxximo is a self improvement tool only. All scores, analysis and recommendations generated by the App are produced by artificial intelligence and are for informational and motivational purposes only. Nothing in the App constitutes medical, dermatological, psychological or professional advice. Always consult a qualified professional before making significant changes to your health, diet or appearance routine.

8. Intellectual Property

The Maxximo app, including its design, code, branding and content, is owned by Maxximo and protected by applicable intellectual property laws. You are granted a limited non-exclusive non-transferable license to use the App for personal purposes only. You may not copy, modify, distribute or create derivative works from the App without written permission.

9. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Maxximo does not warrant that the App will be uninterrupted, error-free, or that AI analysis results will be accurate or suitable for any particular purpose. Use of the App is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Maxximo shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the App, including but not limited to emotional distress resulting from AI generated scores or recommendations. Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.

11. Privacy

Your use of Maxximo is also governed by our Privacy Policy available at mo-static.onrender.com/privacy.html. The Privacy Policy is incorporated into these Terms by reference. By using the App you also agree to our Privacy Policy.

12. Third Party Services

Maxximo uses the following third party services:

• OpenAI: For AI facial analysis. Subject to OpenAI's terms at openai.com/terms
• RevenueCat: For subscription management. Subject to RevenueCat's terms at revenuecat.com/terms
• Apple: For payment processing and app distribution. Subject to Apple's terms at apple.com/legal

13. Changes to Terms

Maxximo may update these Terms at any time. We will notify you of significant changes by updating the "Last Updated" date at the top of this page. Your continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Canada. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Canada.
